The Process

How a Probate Sale Works
in California

California probate sales follow a specific legal process. Here's what you can expect — and how I guide you through every step.

1
Court Appointment
The court appoints an executor or administrator. I connect you with trusted probate attorneys and explain your role from day one.
2
Property Valuation
California law requires a formal appraisal by a probate referee. I coordinate this and provide a market analysis to validate the estate's value.
3
Prepare & Market
Property assessment, any pre-sale improvements, professional photography, MLS listing, and targeted marketing to probate-ready buyers.
4
Offer & Court Petition
Once an offer is accepted, the attorney petitions the court for approval. I prepare for any overbid process the court may require.
5
Court Confirmation
The court confirms the sale. I prepare the executor, handle overbid procedures, and ensure every detail is correctly managed.
6
Close & Distribution
Escrow closes, proceeds are distributed per the court's order. The estate is settled. You can finally breathe.

FAQ

Common Probate Questions

Do I need court approval to sell a probate property in California?
In most cases yes — court confirmation is required. However, if the executor has "full authority" under the IAEA, the sale may proceed without court approval. I'll evaluate your specific situation.
How long does a probate real estate sale take?
Typically 6–12 months from opening probate. The real estate portion adds 3–6 months depending on the court calendar. I work efficiently to minimize delays wherever possible.
Can the property be sold "as-is" in a probate sale?
Yes — probate properties are almost always sold as-is. The estate is not required to make repairs. I price and market accordingly to attract the right buyers.
What is the overbid process?
When court confirmation is required, other buyers can appear at the hearing to submit higher overbids (minimum 5% + $500 above accepted offer). I prepare executors for this and ensure the best outcome.
Do heirs need to agree to the sale?
Not always. The executor has legal authority to sell. Heirs can object under certain circumstances — I work closely with attorneys to navigate family dynamics and keep the process moving.
